Terms of Service

These terms of service (the "Terms") govern the use of the Spark Guide mobile application and the spark-guide.app website (together, the "Service"). By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.

1. Who publishes the Service

The Service is published by Spark Guide LLC, a company incorporated under U.S. law in the State of Wyoming (United States), contact address: 12411 W Fielding Cir, Los Angeles, CA 90094, United States. Contact: contact@spark-guide.app. The Service is hosted by Vercel Inc. (website) and Supabase Inc. (application), within the European Union for the application's data.

2. Independence from the parks

Spark Guide is an independent service. We are not affiliated with, sponsored by, or endorsed by any amusement park, and in particular not by The Walt Disney Company or Disneyland Paris. The names of parks, attractions, and shows mentioned in the Service belong to their respective owners and are used for descriptive purposes only, to help you organize your visit.

3. What the Service does

Spark Guide helps you prepare for and experience a day at an amusement park: activity recommendations, building a day plan, adapting that plan in real time during your visit, estimated wait times.

The proposed plan is a forecast, not a guarantee. Wait times, show schedules, attraction closures, and visit conditions depend on the park and can change at any time. We do our best to estimate and adapt, but we do not guarantee the accuracy of the estimates, the completion of all or part of the plan, or access to any given attraction or show. The Service does not sell admission tickets and does not replace the park's official channels.

4. Your account

The Service can be used with an anonymous account or with an account associated with an email address (verified by a one-time code). The account is reserved for adults. If you enter information about the members of your group (for example the age ranges of children), you confirm that you are authorized to do so, as a parent or guardian.

You are responsible for the accuracy of the information provided and for the use made of your account. You can delete your account at any time from the Profile screen of the application.

5. Pricing

Downloading the application is free. Certain features (the detailed day plan and real-time guidance) are paid:

  • Launch period: visit creation is entirely free until August 31, 2026.
  • From September 1, 2026: a day pass, valid for your entire group and not per person. It is a one-time purchase, with no subscription or automatic renewal: no amount is charged afterward. The applicable prices are those displayed in the application at the time of purchase, all taxes included. The amount actually charged may vary depending on your country and the VAT applied by Apple.

Purchases are made through Apple in-app purchases (App Store). Billing, payment methods, and any refunds are handled by Apple under its own terms. By requesting immediate access to the paid digital content, you expressly consent to its immediate performance and acknowledge that you lose your 14-day right of withdrawal once performance has begun (Article L221-28 of the French Consumer Code).

As a consumer in the European Union, you benefit from the statutory guarantee of conformity applicable to digital content and services; these Terms do not derogate from it.

6. License to use

We grant you a personal, non-exclusive, non-transferable, and revocable license to use the application, for private and non-commercial use. It is prohibited to:

  • resell, rent, or redistribute the Service or its data;
  • automatically extract the Service's data (scraping) or circumvent its technical measures;
  • decompile or disassemble the application, except in cases permitted by law;
  • use the Service for unlawful or fraudulent purposes.

7. Use during your visit

During your visit, stay aware of your surroundings and comply with the park's rules, signage, and safety instructions, which always take precedence over the Service's guidance. You remain the sole judge of the activities suitable for your group (minimum height, health, children's sensitivity).

8. Availability and changes

We strive to make the Service available and reliable, without guaranteeing uninterrupted availability: maintenance, outages, or unavailability of data sources may occur. We may change, suspend, or discontinue features; if a change were to deprive a currently valid pass of its essential content, we would offer a fair solution (for example a pro rata refund via Apple).

9. Liability

The Service is an organization aid tool. To the extent permitted by law, Spark Guide LLC cannot be held liable for the park's decisions (closures, cancellations, actual wait times, access conditions), for indirect damages, or for the consequences of any use of the Service in breach of these Terms. If our liability were engaged, it would be limited, except in cases of gross negligence, willful misconduct, or personal injury, to the amount you actually paid for the Service over the last twelve months.

Nothing in these Terms limits the mandatory rights you have under the law of your country of residence as a consumer.

10. Intellectual property

The application, the website, their original content (text, interface, illustrations, software, algorithms), and the Spark Guide brand are the property of Spark Guide LLC or its licensors. No rights are transferred to you other than the license to use described in Article 6.

11. Personal data

The processing of your personal data is described in our privacy policy, which forms an integral part of these Terms.

12. Termination

You may stop using the Service and delete your account at any time from the application. We may suspend or terminate your access in the event of a serious breach of these Terms, after informing you when possible. Termination does not entitle you to a refund of periods already used, unless otherwise required by law or decided by Apple for in-app purchases.

13. Changes to the Terms

We may modify these Terms, for example to reflect a change in the Service or in regulations. In the event of a significant change, we will inform you in the application or by email before it takes effect. Continuing to use the Service after that date constitutes acceptance of the modified Terms.

14. Governing law and disputes

These Terms are governed by the law of the State of Wyoming (United States), subject to the mandatory consumer protection provisions of the country where you habitually reside: if you reside in France, you retain the benefit of French consumer law and the ability to bring proceedings before the French courts.
